TERMS AND CONDITIONS OF MEMBERSHIP OR SUBSCRIPTION IN PRESTIGIOUS MATRIMONY

This document is an electronic record in terms of the Information Technology Act, 2000 and the rules made thereunder, as applicable and amended. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, requiring publication of the rules and regulations, privacy policy, and terms and conditions for access or usage of www.prestigiousmatrimony.com
(the “Website”).

Please read the following terms and conditions very carefully, as your use of the Website and associated Prestigious Matrimony Services (as defined below) is subject to your acceptance of and compliance with these terms and conditions (the “Terms and Conditions” or “Agreement”), including the policies incorporated herein by reference and as amended from time to time.

ACCESSING, BROWSING OR OTHERWISE USING THE WEBSITE OR PRESTIGIOUS MATRIMONY SERVICES INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS HEREIN. IF YOU DO NOT AGREE, YOU MUST NOT USE THE WEBSITE OR THE PRESTIGIOUS MATRIMONY SERVICES.


DEFINITIONS

In these Terms and Conditions:

“Website” means www.prestigiousmatrimony.com
.

“Company” / “NATTAR INNOVATORS LLP” means NATTAR INNOVATORS LLP, having its registered office at No.34, Aruna Nagar, Srirangam, Trichy, Tamil Nadu – 620006.

“Prestigious Matrimony” / “we” / “us” / “our” means the personalised matchmaking service and brand owned and operated by NATTAR INNOVATORS LLP.

“You” / “User” / “Member” / “Prestigious Matrimony Member” means any end user accessing the Website or using Prestigious Matrimony Services.

“Prestigious Matrimony Services” means the personalised matchmaking services and all related services provided by Prestigious Matrimony / NATTAR INNOVATORS LLP via the Website, Relationship Managers, or otherwise.

“Tenure” means the membership or package period chosen and paid for by you (for example: 3 months, 6 months, till marriage) as shown on the Website or agreed in writing.


1. SCOPE OF SERVICE

1.1 Prestigious Matrimony is a personalised matchmaking service of NATTAR INNOVATORS LLP, valid for the Tenure of the specific package chosen by you and paid for by you.

1.2 Upon successful enrolment and payment, a Relationship Manager (“RM”) may be assigned to assist you in searching, shortlisting, and contacting suitable prospects based on your stated partner preferences, using the database available on the consortium of portals/websites owned or operated by NATTAR INNOVATORS LLP, and other lawful channels.

1.3 Prestigious Matrimony is only an intermediary that facilitates introductions and communication between interested parties; it does not guarantee marriage, engagement, alliance, or any specific outcome.


2. ELIGIBILITY

2.1 Membership and rights of admission are reserved solely for:

Indian nationals and citizens;

Persons of Indian Origin (PIO);

Non-Resident Indians (NRI);

Persons of Indian descent or heritage;

Persons who intend to marry persons of Indian origin.

2.2 By registering, you confirm that:

(a) You are at least 18 years of age if you are a woman, or at least 21 years of age if you are a man;

(b) You are legally competent to marry under the law applicable to you; and

(c) You are not prohibited by any law in force from entering into a valid marriage.


3. ENQUIRIES AND REGISTRATION

3.1 While accessing the Website, you may:

Fill in your details for Prestigious Matrimony to contact you;

Call the contact numbers displayed to enquire about services;

Email your enquiry; or

Chat with the Prestigious Matrimony service team.

3.2 To register, you must complete an online or physical subscription form (“Subscription Form”) and provide true, accurate, current, and complete information, including photographs and supporting documents as requested.

3.3 You alone are responsible for all information provided by you. Efficient matchmaking depends on accurate and complete data; Prestigious Matrimony will reproduce profile details on an “AS IS – AS AVAILABLE” basis for viewing by other Members.

3.4 If at any time Prestigious Matrimony discovers or reasonably believes that information provided by you is untrue, inaccurate, incomplete, or misleading, Prestigious Matrimony may suspend or terminate your membership and forfeit all fees paid, without notice.


4. TENURE

4.1 The Tenure of your membership will depend on the package chosen by you and paid for by you (e.g., 3 months, 6 months, till marriage).

4.2 Upon expiry of the Tenure, services will automatically cease unless renewed with payment of applicable renewal fees under then-current terms.


5. MODE OF PAYMENT

5.1 Payments may be made via cash, cheque, net banking, debit/credit card, UPI, or other approved modes, subject to applicable RBI and banking guidelines. Activation of services is subject to realisation of payment.

5.2 Dishonoured instruments may lead to suspension of services until settlement, and you shall bear all bank charges for cheque/DD/transaction failure.

5.3 Prestigious Matrimony may use third-party payment gateways and shall not be responsible for gateway failures, conversion charges, or delays in bank refunds.

5.4 Where a “pay on success” package is opted, you undertake to pay the balance success fee upon finalisation of your marriage.

5.5 If required by tax law, you agree to provide your PAN or Form 60/61 where the package value is Rs.2,00,000/- (Rupees Two Lakh only) or above.


6. ROLE AND RESPONSIBILITY OF PRESTIGIOUS MATRIMONY

6.1 Upon enrolment, an RM may be assigned to assist you with your matchmaking process during the Tenure.

6.2 Prestigious Matrimony will endeavour to provide profiles as per your partner preferences, subject to availability in its database and subject to the package limits.

6.3 Normal working hours for Prestigious Matrimony services are 9.30 a.m. to 6.30 p.m., Monday to Saturday (Indian Standard Time), excluding Sundays and public holidays (for both Indian and NRI Members).

6.4 Best-effort frequency of profiles: Subject to availability of suitable profiles and the package you have chosen, Prestigious Matrimony shall, on a best-effort basis, endeavour to share approximately 1–3 matching profiles once in every 15 days during the active Tenure. This is indicative only and shall not be construed as a guaranteed minimum number of profiles.

6.5 Prestigious Matrimony is under no obligation to furnish any definite number of profiles where none are available matching your preferences.

6.6 Matching and shortlisting may follow internal guidelines (for example age ranges, marital status compatibility, etc.) and will always be subject to your preferences and data availability.

6.7 Prestigious Matrimony does not independently verify background, financial status, health, or character of each profile; it primarily relies on data furnished by Members.

6.8 Prestigious Matrimony does not guarantee marriage, alliance, “positive response”, or marriage within any particular timeframe.

6.9 Prestigious Matrimony may arrange meetings (physical or virtual) between you and prospects, subject to mutual consent. Costs of such meetings are to be borne/arranged by you and/or the prospect; Prestigious Matrimony is not responsible for those arrangements.

6.10 Prestigious Matrimony strictly prohibits discussion or facilitation of any illegal demands (e.g., dowry) and may terminate membership if such issues come to its notice.


7. ROLE AND RESPONSIBILITY OF MEMBERS

7.1 You must cooperate with your RM and provide accurate contact information (email, phone, etc.) and updated details as requested.

7.2 Every profile shared by Prestigious Matrimony that matches your partner preference is counted as a delivered profile, irrespective of your acceptance or rejection.

7.3 Rejection of a profile after phone discussion still counts towards the profile count. Rejected profiles will not necessarily be “replaced” by additional profiles beyond package limits.

7.4 You are expected to:

Provide recent photographs (not older than 3 months);

Disclose relevant health information (including pre-existing illnesses or disabilities);

Provide accurate information regarding education, income, marital status, etc.

7.5 You are solely responsible for verifying the credentials, background, family, and other details of any prospect before making decisions. You must exercise due diligence and caution.

7.6 You must not:

Enter into financial transactions with prospects before due verification;

Enter into pre-marital physical relationships;

Share highly confidential data (e.g., bank details) without caution;

Use any illegal means or violate any law in force.

7.7 You shall not use profile information shared with you for commercial purposes or for the benefit of third parties.

7.8 Membership is strictly personal, non-transferable, and limited to the registered individual. Competitors or businesses in similar domains must not use the Website or data for commercial gain.

7.9 You cannot “hold” or pause your package; the Tenure runs continuously from the start date until expiry.

7.10 If you fail to update material changes (e.g., marriage already solemnised, change of contact, etc.), Prestigious Matrimony may suspend or terminate your membership.

9. COMMUNICATION WITH MEMBERS

9.1 You consent to receive communications (including service updates and promotional communications) via email, SMS, WhatsApp, phone calls, in-app messages, and other channels from Prestigious Matrimony, the consortium of portals owned by NATTAR INNOVATORS LLP, and their alliance partners.

9.2 By providing your mobile number, you confirm that you will not treat such service/transactional calls or messages as “unsolicited” or complain under DND/NCPR, even if you are registered with any Do-Not-Disturb registry.

9.3 You may receive calls from Prestigious Matrimony / RM as a shortlisted profile for other Members even after your own Tenure has ended, unless you specifically opt-out in writing (which may limit your services).


10. CONFIDENTIALITY AND PROFILE USE (INCLUDING HNI / ID CODE)

10.1 Prestigious Matrimony will take reasonable steps to maintain confidentiality of your personal information, except where disclosure is required by law or for lawful business purposes described in these Terms and the Privacy Policy.

10.2 You grant Prestigious Matrimony permission to process your data (including automated processing) to generate suitable matches and to send you such suggestions.

10.3 You specifically consent that Prestigious Matrimony may, for matchmaking and marketing purposes only:

Use your profile information, preferences, and photographs in anonymised form;

Publish derived matrimonial classifieds and content in newspapers, TV, the Website, social media, YouTube, online/offline directories, and e-magazines;

Use a numbered ID/code or anonymised descriptors instead of your real name, address, or direct contact;

Use such anonymised/ID-coded profile to approach and communicate with high net-worth and ultra high net-worth prospects, maintaining strict confidentiality of your actual identity and contact details unless you expressly consent to disclosure.

10.4 Feedback you provide may be treated as non-confidential and may be used for internal improvement, testimonials (with your consent, where required), and analytics.


11. PRIVACY, DPDP ACT AND DATA PROTECTION

11.1 Prestigious Matrimony is committed to protecting your privacy and will use reasonable technical and organisational measures to safeguard your personal data against unauthorised access, loss, or misuse.

11.2 However, transmission over the internet cannot be guaranteed fully secure, and Prestigious Matrimony shall not be liable for unauthorised access or disclosure due to factors beyond its reasonable control (e.g., hacking, third-party acts).

11.3 You agree to keep profiles shared with you confidential and not to misuse, copy, or publish them.

11.4 You acknowledge that if your profile appears on the consortium of portals of NATTAR INNOVATORS LLP and is indexed by search engines, Prestigious Matrimony has limited control over third-party search engine behaviour and is not liable for such indexing.

11.5 When you use third-party services via the Website (e.g., payment gateway, horoscope services), you authorise Prestigious Matrimony to share the information reasonably necessary to provide those services.

11.6 You confirm that you have read and understood our Privacy Policy, which is incorporated into these Terms by reference and governs how we collect, use, and share your data.

11.7 Digital Personal Data Protection Act, 2023 (DPDP Act)
You understand that your personal data is collected and processed by NATTAR INNOVATORS LLP as a “Data Fiduciary” under the Digital Personal Data Protection Act, 2023 (DPDP Act), for the lawful, specific and limited purpose of providing matrimonial introduction and related services. By accessing the Website or registering/using the Prestigious Matrimony Services, you provide your free, specific, informed and unambiguous consent to such processing, and to the sharing and use described in these Terms and in the Privacy Policy.

As a “Data Principal”, you have rights under the DPDP Act, including the right to:

Access, correct, and update your personal data;

Request erasure of your personal data (subject to legal and contractual requirements);

Withdraw your consent prospectively.

You may exercise these rights by contacting our designated Grievance Officer or the contact provided in the Privacy Policy. You acknowledge that if you withdraw consent or request erasure, Prestigious Matrimony may be unable to provide some or all Services and may suspend or terminate your membership as per these Terms.

The Grievance Officer shall be available between 10.00 a.m. and 6.00 p.m. IST, Monday to Saturday, excluding Sundays and public holidays.


13. DISPUTES BETWEEN MEMBERS

13.1 Members are solely responsible for their interactions with each other. Prestigious Matrimony is not a party to communications, meetings, or arrangements between Members.

13.2 Prestigious Matrimony does not assume liability for disputes, misrepresentations, or any consequences arising out of Member-to-Member interactions, meetings, or transactions.

13.3 Prestigious Matrimony has no obligation to monitor or mediate disputes but may choose to suspend or terminate profiles if serious complaints are received.


14. CONTENT AND INTELLECTUAL PROPERTY RIGHTS

14.1 You are responsible for all content you provide, including profile data, photos, and messages. You represent that you have all necessary rights to such content.

14.2 By submitting content, you grant Prestigious Matrimony a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to use, reproduce, distribute, display, and create derivative works for the purposes of operating, promoting, and improving the Services.

14.3 Prestigious Matrimony may remove content or suspend profiles that violate these Terms or any law, including impersonation or misuse of another’s identity.

14.4 “Prestigious Matrimony” is a brand owned by NATTAR INNOVATORS LLP. All associated logos, trademarks, and proprietary information are the intellectual property of NATTAR INNOVATORS LLP. Unauthorised use or copying may lead to legal action.


15. RENEWAL

Before expiry of the Tenure, you may renew your membership by paying the applicable renewal fee and accepting the then-current Terms and Conditions.


16. FEES, REFUNDS AND NON-TRANSFERABILITY

16.1 Membership / subscription fees are payable in advance for the chosen package.

16.2 Fees are personal, non-transferable, and non-assignable to any other person or product.

16.3 Refund rule with 5-day window:
As a general rule, fees are non-refundable, except that if you submit a written request to cancel your Prestigious Matrimony package within 5 (five) calendar days from the date of payment and before Prestigious Matrimony has shared even a single matching profile with you, Prestigious Matrimony may process a full refund of the package fee actually received from you.

16.4 After the earlier of:

expiry of the above 5-day window; or

the date on which even one matching profile has been shared with you,

no refund of any kind shall be payable, even if:

you do not like or respond to any profiles;

no marriage/alliance materialises; or

you discontinue using the Services before Tenure expiry.


17. THIRD-PARTY WEBSITES AND SERVICES

17.1 The Website may contain links to third-party websites and advertisements. Prestigious Matrimony does not control or endorse such third-party content and is not responsible for their terms, policies, or actions.

17.2 Any use of third-party services (e.g., horoscope, payment gateway) is at your sole risk and governed by those third parties’ terms.

17.3 Prestigious Matrimony reserves the right to add, modify, suspend, or discontinue any service or feature, with or without notice.


18. LIMITATION OF LIABILITY

18.1 Exchange of profiles shall not be construed as an offer, recommendation, or guarantee of suitability.

18.2 To the maximum extent permitted by law, NATTAR INNOVATORS LLP / Prestigious Matrimony and its officers, employees, and agents shall not be liable for any indirect, special, incidental, or consequential damages, including emotional, social, or reputational loss.

18.3 Notwithstanding anything to the contrary, Prestigious Matrimony’s total liability, if any, for any claim arising out of or relating to the Services shall not exceed the total fees actually paid by you for the current package.

18.4 Prestigious Matrimony is not liable for:

Wrong matches due to incorrect or incomplete data;

Any financial transactions between you and prospects;

Lack of response or non-reciprocation from prospects;

Technical issues beyond its reasonable control (network, hardware, etc.).


19. GENERAL PROVISIONS AND USER OBLIGATIONS

19.1 Use of the Website shall be deemed to occur when it is loaded or accessed on any device used by you.

19.2 The Website acts as an intermediary under the Information Technology Act, 2000.

19.3 You must not host, upload, publish, or share any content that:

belongs to another person without right;

is defamatory, obscene, pornographic, or otherwise illegal;

harms minors;

infringes intellectual property;

violates any law;

is misleading, offensive, or threatens national security.

19.4 Prestigious Matrimony reserves the right to delete or block profiles and content that violate laws or these Terms.


20. DISCLAIMER

20.1 The Website and Prestigious Matrimony Services are provided on an “AS IS” and “AS AVAILABLE” basis without any warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.

20.2 Prestigious Matrimony does not give any explicit or implied guarantee or warranty of marriage, alliance, or any specific result.

20.3 You expressly agree that your use of the Website and Services is at your sole risk.


21. INDEMNITY

You agree to indemnify, defend, and hold harmless NATTAR INNOVATORS LLP, Prestigious Matrimony, its directors, officers, employees, and agents from and against any claims, demands, losses, liabilities, and expenses (including legal fees) arising out of:

your use or misuse of the Services;

breach of these Terms;

violation of any applicable law; or

infringement of any third-party rights.


22. BREACH AND TERMINATION FOR CAUSE

22.1 If Prestigious Matrimony receives credible complaints or feedback that you:

seek unlawful financial/physical favours;

provide false information;

engage in illegal or abusive conduct; or

otherwise violate these Terms,

Prestigious Matrimony may, in its sole discretion, suspend or terminate your membership and forfeit all fees, without notice.

22.2 Prestigious Matrimony reserves the right to file police complaints or take legal action in case of serious or criminal breach.


23. TERMINATION BY EITHER PARTY

23.1 Your membership may be terminated by either you or Prestigious Matrimony at any time by written notice of 7 days, subject to these Terms.

23.2 On termination, your right to use the Services ceases immediately. No refunds will be payable except where expressly provided (e.g., the 5-day window under Clause 16).

23.3 Rights and obligations which, by their nature, survive termination (including limitation of liability, indemnity, and IP rights) shall continue in force.


24. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of India. Subject to the arbitration clause below, the Courts at Tiruchirappalli (Trichy), Tamil Nadu, India shall have exclusive jurisdiction over all disputes arising out of or in connection with this Agreement or the Services.


25. ARBITRATION OF DISPUTES

25.1 Parties shall first attempt to resolve disputes amicably within 30 days of the dispute being raised.

25.2 If not resolved, disputes shall be finally settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996, by a Sole Arbitrator appointed by NATTAR INNOVATORS LLP.

25.3 The seat and venue of arbitration shall be Tiruchirappalli (Trichy), Tamil Nadu, India. Arbitration shall be conducted in English.

25.4 Nothing prevents Prestigious Matrimony from seeking interim relief from courts at Tiruchirappalli (Trichy).


26. ENFORCEMENT

26.1 Any proceedings to enforce the arbitration clause or seek interim relief in aid of arbitration shall be brought exclusively before competent courts at Tiruchirappalli (Trichy), Tamil Nadu, India.

26.2 If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
